These Website Terms of Use ("Terms of Use") govern your access to and use of the Pincite website. They form a binding agreement between you and Pincite Pty Ltd (ACN [insert] | ABN [insert]) ("Pincite", "we", "us" or "our").
By accessing or browsing the Website, you agree to these Terms of Use. If you do not agree, you must not use the Website.
Capitalised terms have the meanings given to them in clause 13 (Definitions).
1. About this Website
The Website includes our marketing pages, our User Guide, our Index, Pricing and reference content, and all other publicly accessible pages at https://pincite.com.au. These Terms of Use apply to all of it.
2. Educational content, not advice
2.1 General educational purpose. Website Content, including the User Guide and our reference pages, is provided for general educational purposes only. It is not legal advice, academic advice, or professional advice of any kind, and it is not a substitute for the official AGLC4 or for your institution's own requirements.
2.2 No guarantee of accuracy. Subject to clause 2.3, we do not guarantee that Website Content is accurate, complete or current. You should always verify against the current AGLC4, or with your institution. Citation rules change, are interpreted differently by different markers, and contain edge cases.
2.3 Australian Consumer Law rights preserved. Nothing in this clause 2, or elsewhere in these Terms of Use, excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
3. Our Content and permitted use
3.1 Ownership. The Guide, our reference pages, and all text, graphics, logos and other Website Content are original works written by us, and belong to us or our licensors. They are protected by copyright.
3.2 Permitted use. You may view, read, print and use Website Content for your own personal, non-commercial study. You may link to the Website.
3.3 Restrictions. You must not, without our written permission:
- (a) copy, republish, redistribute or reproduce Website Content elsewhere;
- (b) use Website Content to train, fine-tune or develop any artificial intelligence or machine learning model;
- (c) use Website Content to build or assist a competing product or service; or
- (d) use scrapers, bots, crawlers or other automated means to extract Website Content in bulk.
4. Acceptable use
You must not:

"AGLC" and "Australian Guide to Legal Citation" are the property of their respective owners. Pincite is not affiliated with, endorsed by, or connected to the publishers of the AGLC4, or the University of Melbourne. Our use of those terms is descriptive only.
6. Third-party links
The Website may link to external resources. We do not control those sites and are not responsible for their content, accuracy or availability.
7. Availability
We aim to keep the Website available, but we do not guarantee uninterrupted or error-free access. We may change, add to, or remove Website Content at any time.
8. Relationship with our other documents
- (a) These Terms of Use govern general browsing of the Website.
- (b) Our Terms and Conditions govern when you create an account, start a free trial, or subscribe.
- (c) Our Privacy Policy explains how we handle your personal information, and applies to both.
If there is any conflict between these Terms of Use and the Terms and Conditions, the Terms and Conditions prevail.
9. Liability
9.1 Australian Consumer Law rights come first. Nothing in these Terms of Use excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified. Everything else in this clause 9 is subject to this clause 9.1.
9.2 "As is". Subject to clause 9.1, the Website and Website Content are provided on an "as is" and "as available" basis, and we exclude all warranties other than those that cannot be excluded by law.
9.3 Exclusion of loss. Subject to clause 9.1, we are not liable for any loss arising from your use of, or reliance on, the Website or Website Content, including indirect or consequential loss, lost marks, or academic outcomes.
9.4 Liability we never exclude. Nothing in these Terms of Use excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.

13. Definitions
In these Terms of Use:
"AGLC4" means the Australian Guide to Legal Citation, 4th edition.
"Australian Consumer Law" means Schedule 2 to the Competition and Consumer Act 2010 (Cth).
"Privacy Policy" means our privacy policy, available at https://pincite.com.au/privacy, as updated from time to time.
"Terms and Conditions" means our Terms and Conditions governing the Pincite citation tool, available at https://pincite.com.au/terms, as updated from time to time.
"Terms of Use" means these Website Terms of Use, including clause 13 (Definitions).
"Website" means the Pincite website at https://pincite.com.au and its subdomains and pages.
"Website Content" means the Guide, reference pages, text, graphics, logos and other content we make available on the Website. It does not include user content, which is governed by the Terms and Conditions.
"you" and "your" mean the person accessing the Website.
